1. Overview

Pickle & Padou is operated by ESIKA PTE. LTD. (“Pickle & Padou,” “we,” “us,” or “our”). Our online store is powered by Shopify.

These Terms of Service (“Terms”) govern your access to and use of our website, products, and related services (collectively, the “Services”).

By accessing our website or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and any other policies posted on our website. If you do not agree, please do not use the Services.

2. Eligibility and Account Information

You agree to provide accurate, current, and complete information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

3. Products

We make reasonable efforts to display product descriptions, images, colors, sizes, and other information accurately. However, colors and appearance may vary slightly depending on your screen settings, device, lighting, production process, and fulfillment location.

Minor variations may occur between products because items are produced individually. Such minor variations do not constitute defects.

We reserve the right to modify or discontinue products, designs, colors, sizes, descriptions, or availability at any time without prior notice.

4. Made-to-Order Products

Our products are made to order and enter production after an order is placed.

Orders cannot be canceled or modified once placed. Please carefully review your selected product, size, color, quantity, shipping address, and other order details before completing your purchase.

Returns, replacements, and refunds are handled in accordance with our Refund Policy and applicable consumer protection laws.

5. Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, or cancel an order where reasonably necessary, including in cases involving:

• Payment authorization issues
• Suspected fraud or unauthorized activity
• Pricing or product information errors
• Product unavailability
• Shipping restrictions
• Violation of these Terms

If we cancel an order after payment has been received, we will issue an appropriate refund to the original payment method.

Products purchased through the Services are intended for personal or household use and not for unauthorized commercial resale.

6. Prices and Payment

Prices may change without notice. The price charged will be the price displayed at checkout when the order is placed.

Unless otherwise stated, product prices may exclude shipping charges, taxes, customs duties, import fees, or other charges imposed by the destination country. Any applicable charges will be displayed at checkout where available.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method provided.

7. Shipping and Delivery

Delivery dates are estimates and are not guaranteed. Production and shipping times may vary depending on the product, destination, carrier, customs processing, and circumstances outside our reasonable control.

We are not responsible for delays caused by shipping carriers, customs authorities, incorrect or incomplete shipping information, severe weather, or other events beyond our control.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges may apply if an order is returned or requires reshipment because of an incorrect or incomplete address, an unclaimed package, or a failure to complete required customs procedures.

Customers are responsible for customs duties, import taxes, and related fees imposed by the destination country unless otherwise stated at checkout.

Nothing in this section limits any rights available under applicable consumer protection laws.

8. Intellectual Property

All content made available through the Services, including the Pickle & Padou name, logos, designs, graphics, product artwork, photographs, text, videos, and website layout, is owned by or licensed to us and is protected by applicable intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, sell, license, publish, display, or otherwise use our content without prior written permission.

Third-party names, trademarks, and logos appearing on products or through the Services remain the property of their respective owners.

9. Reviews and Feedback

If you submit a review, photograph, comment, suggestion, or other content (“Feedback”), you confirm that you have the right to provide it and that it does not infringe the rights of another person.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, edit, and publish the Feedback for operating, improving, and promoting the Services.

We may remove Feedback that we reasonably consider unlawful, misleading, abusive, offensive, infringing, or otherwise inappropriate.

12. Relationship With Shopify

Our store is powered by Shopify, which enables us to provide the Services. Purchases made through our store are transactions directly between you and Pickle & Padou.

Shopify is not the seller of our products and is not responsible for the products, order fulfillment, customer service, refunds, replacements, or other aspects of transactions between you and Pickle & Padou.

13. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

Because our store is hosted by Shopify and orders are fulfilled through service providers such as Printful, personal information necessary to process and deliver orders may be shared with these providers as described in our Privacy Policy.

14. Errors and Inaccuracies

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We reserve the right to correct errors, update information, or cancel affected orders. If an order is canceled after payment because of an error, an appropriate refund will be issued.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, or error-free. Nothing in these Terms excludes any warranty, guarantee, or consumer right that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive, or consequential losses arising from your use of the Services or products purchased through the Services.

Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot legally be limited or excludes rights available under applicable consumer protection laws.

Nothing in this section deprives consumers of any mandatory protections available under the laws of their country or region of residence.
